EXECUTIVE DIRECTOR REPORT

MCPA expresses our deepest condolences to the Fargo Police Department and their community following the tragic line-of-duty death of one of their officers and the critical injury of two additional officers. We share in their grief and send thoughts of comfort to their agency, the families involved, and the residents of Fargo.

As of today, I am aware of the following information regarding Officer Jake Wallin's funeral. 

Location: Pequot Lakes High School, Pequot Lakes, MN
Time: Saturday, July 22, 2023 at 10:30 a.m.

There will be no visitation prior to the service. Fargo PD will be processing the urn to Pequot Lakes Saturday morning. Service will be held in the school gymnasium (with auxiliary spaces with seating for 3,000) with law enforcement honors outside the school after.

If any other details come up from now until then we will post them in Tradewing.

COMMUNITY PARTNERSHIPS GRANT PROGRAM

Need funding to support your community engagement efforts?

The MN Chiefs of Police Foundation (MCPF) has opened the second round of its Community Partnerships Grant Program with $25,000 in available funding to help your agency deepen trust and partnerships with your community. This grant cycle opens Monday, June 26, and closes on August 4, 2023. All MCPA member agencies are eligible to submit a grant application. However, an agency is not eligible to apply if it has already received a grant this year.

POST NEW POST RULES CHANGES VIRTUAL SESSION

If you missed the virtual session earlier this week you can now view the recording. POST Executive Director Erik Misselt discussed the new rule changes and new legislation that impact POST and your agencies. The league of Minnesota Cities is also hosting an upcoming webinar about understanding the impact of the Public Safety Duty Disability Law. You can register to attend that webinar on July 11 from 11 am-12 pm.


KSTP SEGMENT ON THE NEW BCA REPORT

Last week, KSTP aired a segment about the BCA report on no-knock warrants. The state’s first full-year no-knock warrant report has been released. You can view the full report online.

Executive Director Potts was interviewed for this segment and shared how there will likely be even fewer no-knock warrants happening in the future and how agencies have already been turning to technology instead of no-knock warrants. You can view this interview at KSTP-TV.

LEGAL ASSISTANCE PROGRAM (LAP)

Take advantage of the Legal Assistance Program (LAP). This is a great opportunity for all Chiefs and Command Staff members to get legal assistance at a very affordable rate ($150 per year). And, a reminder to those who signed up for LAP last year, the plan year ends June 30. Be sure to renew to avoid any lapses in coverage. 

Some highlights of the first year:

  • We had approximately 100 participants
  • Several members reached out to Legal Assistance
  • The Attorneys representing our members were very responsive and successful in resolving issues
  • The services were valuable and very appreciated.

The new plan year begins July 1, and renewal invoices have been sent out already. If you didn't receive your renewal invoice, or if you want to join the program for the first time please use this link. The cost is unchanged from last year at $150 and payments are due June 30. If you did not enroll in the program during its first year, you should strongly consider enrolling for 2023-2024.

SAVE THE DATE FOR ETI 2024

We can safely confirm the dates of the 2024 Executive Training Institute (ETI) are April 15-18, 2024 in St. Cloud. ETI is a world-class annual training event and EXPO, attracting more than 400 law enforcement leaders from across Minnesota. We bring in national, regional and local experts to share information and insights on some of the most pertinent public safety topics today.

EXECUTIVE DIRECTOR REPORT

Last Wednesday, we wrapped up this year's Critical Issues Series. This year we tried something new by offering the series in person and online. We have approximately 130 attendees at each session. The series included some important and timely topics. If you have registered for this training the recordings have been made available. 

The final training included a session on: 

  1. Use of Force 2.0 (Duty to Intervene and Duty to Render Aid) by Imran Ali
  2. State-funded recruitment Programs (Intensive Comprehensive Police Officer Education Program and Pathways to Policing grants by Mary Vukalich and Kristian Lail
  3. New Cannabis Laws (Enforcement, Searches, and Employment issues) by Mitchel Cell and Imran Ali.

LEADERSHIP ACADEMY

This week at Camp Ripley, the MCPA is conducting our 3rd Leadership Academy of 2023.

We have 42 new leaders from agencies all over the state attending this week's Leadership Academy. This course has been updated to include relevant and timely presentations that will help prepare new leaders for the challenges they will face in their new positions.

We will be offering this course in May 2024. There is high demand for this course. Register online if you would like to reserve a seat for new leaders in your agency.

MCPA HIRING A DIRECTOR OF MN LAW ENFORCEMENT ACCREDITATION PROGRAM

MCPA has been selected by the U.S. Department of Justice to receive a grant for approximately $360,000 to develop and implement a Statewide Law Enforcement Accreditation Program.

Law enforcement accreditation is a self-initiated, voluntary process where agencies operate within a specific set of state and nationally recognized standards or best practices within the industry. Accrediting bodies compile these best practices and regulations into standards manuals. 

To maintain and prove compliance with these standards, agencies typically have to develop policies, training, and accountability for areas such as:

  • High-liability areas (vehicle pursuits, vehicle operation, critical incident response, investigative techniques, use of force, etc.)
  • Personnel management
  • Evidence handling

We will begin the process of developing the Minnesota accreditation program over the coming months. One of the first steps will be to hire a person to manage and develop the program. Please see the new job description for the Director of Minnesota Law Enforcement Accreditation Program. Please share this with anyone you think is qualified.


CLEO & COMMAND ACADEMY

Transform your law enforcement career and take your leadership skills to new heights with CLEO & Command Academy. This Academy is designed to empower law enforcement professionals like you with the knowledge, skills, and insights necessary to excel in the dynamic world of law enforcement leadership. CLEO & Command Academy is a 5-day course taking place February 5-9 at Camp Ripley in Little Canada. The Academy provides the essential training that addresses daily duties and administration that chiefs and high-ranking supervisors use.

The Minnesota POST Board has approved CLEO as essential training for Minnesota police chiefs (33 credits). Seasoned instructors with experience in police leadership or legal expertise in Minnesota teach the Training Academy.

TOM DECKER MN LAW ENFORCEMENT FUND

As you know, November 29 marked the 11th anniversary of Officer Decker's EOW. We keep Tommy and all fallen officers and their families in our prayers.

Here is a wonderful photo album of last year's commemoration ceremony created by Jackie Bergeron from Minnesota Cops. It is a great keepsake as a way of honoring all of our brave men and women in blue.

Thanks to all of you who made the beautiful Officer Tom Decker Minnesota Law Enforcement Memorial a reality this year, as it stands proudly in front of the Cold Spring Police Station.

NATIONAL NIGHT OUT (NNO) 2023

The National Association of Town Watch awarded Maple Grove 1st Place in its population class of 50,000–100,000 for their city’s NNO activities in 2023. Twenty-three other cities across the nation received awards in the same population class. Brooklyn Park is the only other Minnesota city in this population class to receive an award at 4th Place. The top ten ranked cities in our population class are listed below. Minneapolis and St. Paul are the only additional Minnesota cities receiving awards for NNO events. Those cities ranked 5th and 8th, respectively, within the population class over 300,000.

EXECUTIVE DIRECTOR REPORT

MCPA continues to lead efforts to seek a solution to the new School Resource Officer laws that have been causing uncertainty and concerns among agencies across the state. 

Yesterday afternoon, Eagan Chief Roger New, MCPA General Counsel Andy LeFevour, and I, along with Representatives from the Minnesota Sheriffs Association, MPPOA, and League of Minnesota Cities, met with the Commissioners of DPS, Department of Education and Several Representatives from Governor Walz office. During this meeting, we explained in detail why this law is causing concerns. We also provided a suggestion as to how this new law could be modified to remove our concerns and pave the way for all SRO's to return to schools immediately. We suggested removing any reference to "SRO's" and "other officers contracted by the district" from Section 121A of Minnesota Statute. We explained that Minnesota statute 609.06 provides clear guidance on police officer Use of Force. As you all know, the statute was amended in 2021 to prohibit chokeholds and some other restraints. We feel strongly that creating two different standards for the use of force creates confusion and is simply not necessary. During the meeting, we asked the Governor's Staff to address this issue with a special session that is singularly focused on fixing the law. 

Despite ongoing discussions and media coverage, Governor Walz seems reluctant to call for a special session. Members of both parties, including the Governor, have indicated a willingness to address the language in this law come February. House and Senate Republicans held a press conference yesterday to address this. During this press conference, Blaine Chief Brian Podany spoke about the challenges and concerns created by the new law. Republican members from the House and Senate have prepared a bill to repeal the changes made to Minnesota Stature 121A entirely.

To help provide you with as much information as possible on this issue, we have started a running list of Police and Sheriff's Departments who have suspended their SRO programs or have decided not to renew a contract for the upcoming school year. CALL TO ACTION:
Please contact your local elected officers from the Minnesota Senate and House of Representatives and encourage them to ask the Governor to call for a Special Session to fix this law so ALL SROs can return to their schools. A special session could be conducted over a virtual platform, taking less than 2 hours. There is no reason why this issue can't be fixed before next Tuesday.

EXECUTIVE DIRECTOR REPORT

On Monday, I sent this letter to Governor Walz regarding the new SRO laws we recently learned about. I have heard from many Chiefs expressing their frustration and disappointment around this seemingly surprising new law just passed. MCPA is actively working to get answers and solutions to this. Getting this addressed by him and his office is our top priority. 

Since the letter was sent the media has started to pick this up as a story. Thank you to Chief Mike Dahlstrom and Chief Roger New for speaking with KSTP.
